San Diego: Fatal Wrong-Way Highway Crash on SR 56

San Diego Highway Crash Lawyers

A 22-year-old was killed by a wrong-way driver on SR 56 in Rancho Penasquitos.

Fatal highway crash: A 22-year-old man was killed Thursday when a wrong-way driver slammed into his car on State Route 56 in Rancho Penasquitos, 20 miles north of central San Diego.

•   An 18-year-old in a Land Rover SUV veered across the center median of State Route 56 and slammed head-on into an oncoming Toyota Scion.

•   The 22-year-old driver of the Scion died at the scene.

•   The wrong-way driver was hospitalized with severe injuries.  Police suspect he was under the influence of some kind of medication or controlled substance at the time of the fatal accident.

The deadly head-on car accident occurred shortly after 9:30 a.m., according to a CBS Channel 8 News report.

California Highway Patrol officials said 18-year-old Timothy Barnette of San Diego was driving a 2002 Land Rover Discovery SUV eastbound on State route 56 when he suddenly lost control and veered across the sandy center median into oncoming traffic.

The Land Rover slammed head-on into a westbound 2010 Toyota Scion driven by 22-year-old Nick Hart.

Marine Corps veteran Danny Donnellan, who was driving behind the Scion witnessed the entire accident. He said the impact launched the Land Rover “almost straight up in the air.” Barnett was ejected from his vehicle and had to be removed from underneath the SUV, which had traveled up an embankment.

Donnellan, who served two tours of duty in Afghanistan, tried to use his first aid training to assist the victims but Hart — who had to be extricated from his crushed compact car — had no pulse and was bleeding profusely from his ear.

“He had obviously suffered a blunt trauma to the head,” Donnellan told CBS8 News. Hart died at the scene.

Donnellan said the wrong-way driver, Barnette, was conscious but in shock and “obviously very confused as to what had happened.”  Barnette was taken to Scripps Memorial Hospital in La Jolla to be treated for severe injuries. He later was reported to be in fair condition.

CHP investigators suspected that Barnette was under the influence of some type of medication or other controlled substance at the time of the crash. A spokesman for the CHP said criminal charges were expected to be filed against the 18-year-old, pending toxicology results.

Bonsall: Driver High on Marijuana in Head-On Crash, 1 Dead

San Diego Car Accident Lawyers

A woman was killed and three of her family were hospitalized when their car was hit by a drugged driver near Bonsall.

Fatal car accident: A 53-year-old mom was killed Sunday when a driver who was high on marijuana crossed a double yellow line and crashed head-on into her vehicle on State Route 76 in North San Diego County near Bonsall.

•  A 22-year-old man who was high on marijuana lost control of his pickup truck and crossed a center line into oncoming traffic.

•  The pickup truck slammed head-on into a car. The driver of the car was killed. Her husband, daughter and grandson were hospitalized.

•  The truck driver had a lot of marijuana in his truck and admitted to smoking some earlier. He was arrested at the scene and faces multiple charges, including gross vehicular manslaughter, driving on a suspended license, and five counts of DUI causing bodily injury.

The drugged driving crash occurred about 1½ miles east of Interstate 15 at 3:22 p.m., according to a report in the San Diego Union-Tribune.

California Highway Patrol Officer Jim Bettencourt said 22-year-old Menifee resident Jonathon David Roberts was under the influence of marijuana when he drove his westbound 1997 Dodge Ram pickup truck across the double yellow line and into oncoming traffic on State Route 76 on Christmas Eve.

Witnesses said Roberts had been swerving all over the road before that. He had veered to the right and then suddenly jerked the truck back to the left when he crossing into the eastbound lane. The truck then slammed head-on into an eastbound 2010 Honda Fit driven by 53-year-old Socorro Aguirre-Reynosa of Oceanside.

Aguirre-Reynosa died at the scene. Her husband, 30-year-old daughter, and 13-year-old grandson suffered serious injuries and were hospitalized at Palomar Hospital, Bettencourt said.

A 2004 BMW 328i traveling behind the Honda apparently swerved to avoid being hit  and her car went off of the south side of the road and down an embankment. The driver, a Carlsbad woman whose name was not released, was taken to a hospital to be treated for injuries she suffered. The nature and severity of her injuries was not known.

Roberts, who had a large amount of marijuana in his car, admitted to smoking some earlier in the day, Bettencourt said. He was arrested at the scene and then taken to Palomar Hospital to be treated for minor injuries. He was booked into Vista jail.

Roberts faces multiple charges, including gross vehicular manslaughter, driving on a suspended license, and five counts of driving under the influence causing bodily injury.

Cotati: Teen Arrested for Driving on Drugs in Head-On Crash

Cotati Car Accident Lawyers

A 19-year-old driver was arrested for being under the influence of drugs in a head-on crash in Cotati.

DUI crash: A 19-year-old was arrested early Tuesday for driving under the influence of drugs after a head-on collision that critically injured the other driver on Stony Point Road in Cotati.

•   A teen driver who appeared to be high on drugs veered across a double yellow line and into oncoming traffic on a rural road.

•   His pickup truck crashed head-on into an SUV. Both drivers were trapped in their vehicles.

•   The driver of the SUV suffered critical injuries and was airlifted to Stanford Hospital.

•   The teen driver was arrested for driving under the influence of drugs and then taken to a local hospital to be treated for injuries he sustained in the accident.

The car accident occurred at about 8:30 a.m. in heavy fog, according to a report in the Santa Rosa Press-Democrat.

California Highway Patrol Officer Jonathan Sloat said 19-year-old Ben Rhoades of Sebastopol was driving a Ford F250 pickup truck south on Stony Point Road when he veered across the double yellow line into the northbound lane just south of West Sierra Avenue.

Rhoades’ truck slammed head-on into an oncoming Ford Escape driven by 46-year-old Vicki Siefer of Novato, Sloat told the Healdsberg Patch news site.

There were conflicting news reports about which of the vehicles rolled over, but both drivers were trapped inside their vehicles and had to be extricated by firefighters.

Battalion Chief Steve Davidson told the Press-Democrat that getting her out of her car took about 45 minutes and was one of the most complicated extrications Rancho Adobe firefighters have ever handled.

“Part of the upper half of her body was outside of the wrecked vehicle but her legs were trapped inside,” the Press-Democrat reported. “Firefighters had to cut parts of the car away to get her legs untangled from the wreckage.”

Siefer suffered major injurieswhich were considered to be life-threatening. She was airlifted via helicopter to Stanford Medical Center in critical condition, Sloat said.

Rhoades appeared to be intoxicated, officers said. He was arrested and taken to Santa Rosa Memorial Hospital to be treated for injuries he sustained in the accident. He was listed in fair condition.

Officials closed Stony Point Road for about 90 minutes.

Victorville: Passenger Killed in Wrong-Way Freeway Crash on I-15

Victorville Freeway Accident Lawyers

A passenger was killed in a wrong-way freeway accident on I-15 in Victorville.

Wrong-way freeway accident: One person was killed and another seriously injured Saturday when a driver on drugs drove the wrong way and crashed into another vehicle at 100 mph on Interstate 15 in Victorville.

•   A man on drugs drove a Jeep Cherokee the  wrong way on the freeway at about 100 mph and crashed head-on with a Mazda.

•   The Mazda was pushed into the center divider. The driver was hospitalized with major injuries.

•   A passenger in the wrong-way Jeep died at the scene.

•   The wrong-way driver was arrested at the scene and then treated for his injuries.

The head-on car accident occurred on southbound Interstate 15 near Bear Valley Road, shortly after 7:30 a.m., according to an article in the Victorville Daily Press.

California Highway Patrol Officer Mario Lopez said 33-year-old Phelan resident Ernesto Vargas was under the influence of drugs when he drove a white Jeep Cherokee onto the freeway in the wrong direction.

Authorities did not know exactly where Vargas entered the freeway, witnesses reported seeing him as far back as the Highway 395 on-ramp, Lopez said.

“The vehicle was reportedly traveling at approximately 100 mph,” Lopez said.

Vargas drove at that high speed for least six miles in the wrong direction before he crashed head-on into  a black Mazda driven by a man from Fort Irwin. The impact sent both vehicles into a spin and pushed the Mazda onto the center median rail.

The driver of the Mazda, whose identity was not released by the CHP, suffered moderate to major injuries and was hospitalized at Arrowhead Regional Medical Center.  CHP officials said his injuries did not appear to be life-threatening.

A passenger in the Cherokee, Kellie Sue Hughes, died at the scene.

Vargas was trapped in his vehicle. He fought with rescuers who were trying to pull him from his wrecked vehicle. He had to be subdued with a Taser. The CHP arrested him at the scene and then he was transported to Desert Valley Hospital to be treated for injuries he sustained in the accident, including a broken leg.

Officials closed the southbound side of the freeway for about two hours while the CHP conducted a preliminary investigation.

Court records show that Vargas was previously convicted in San Bernardino County of drug possession, assault with a deadly weapon, and disturbing the peace.

San Diego: 6 Hurt in Wrong-Way Crash on SR-94

San Diego Car Accident Lawyers

Six people were injured when a wrong-way driver crashed into two cars on State Route 94 in San Diego.

Freeway crash: Six people were injured Saturday night when a wrong-way driver crashed into two cars on the State Route 94 freeway in Lemon Grove, about 8 miles from downtown San Diego. The driver carjacked another vehicle before he was arrested.

A 65-year-old driver, who apparently was on drugs, drove the wrong way on the freeway and crashed into three vehicles.

Six people were injured and taken to hospitals.

The wrong-way driver ran away on foot and then allegedly carjacked a Cadillac to try to escape.

 •   Police arrested the driver on charges of felony hit-and-run and driving under the influence of drugs.

The car accident occurred between 7:20 and 7:50 p.m., according to a report in the San Diego Union-Tribune.

The California Highway Patrol said motorists first reported the wrong-way driver at 7:23 p.m., when they spotted a dark Ford Mustang traveling westbound in the eastbound lanes of State Route 94 — also known as the Martin Luther King Jr. freeway -near Massachusetts Avenue in Lemon Grove.

California Highway Patrol officer John Alvarez said the Mustang, driven by 65-year-old Selven Parson of Valley Center — crashed into another car and then hit an SUV at Federal Boulevard about three minutes later.

One of the passengers in the SUV said her husband was driving the vehicle eastbound when Parson’s Mustang, spun out and slammed into the SUV. The impact sent the SUV out of control. It crashed into guardrails on both sides of the freeway before it finally came to a rest, she told the Union-Tribune.

Alzarez said that six family members in the SUV were transported to hospitals to be treated for injuries they suffered in the accident. He said the driver of the first car that Parson crashed into was not injured.

A third vehicle ran into some debris left by the first two crashes, but no injuries were reported in that collision.

San Diego police said Parson jumped out of the disabled Mustang, ran down the freeway ramp, and tried to get away in another driver’s Cadillac. The Union-Tribune reported:

[Parson] allegedly jumped into a woman’s Cadillac, threatened her with a screwdriver and forced her to drive him along Federal for several blocks, San Diego police said. Then he got out and tried to hide under a parked truck, but a police helicopter crew using infrared discovered his hiding place, police said.

Parson was arrested at 7:50 p.m. and will face charges of felony hit-and-run and driving under the influence of drugs, Alvarez said.

Tulare Drunk Driving Accident Lawyers

Four people were injured when a drunk driver ran through a stop sign at this intersection in Tulare and struck another vehicle.

Four people were injured in a drunk driving accident Thursday morning when the driver ran a stop sign and crashed into another vehicle just outside the Tulare city limits. The driver fled the scene but was found and arrested.

•   A 21-year-old driver under the influence of both alcohol and drugs ran a stop sign, crashed into another vehicle, and fled the scene.

•   The other driver and three passengers were seriously injured.

•   Police found the drunk driver at the home of one of the injured passengers and arrested him on charges of  felony hit-and-run and driving under the influence of alcohol and drugs.

The hit-and-run crash occurred at 2:45 a.m. at the intersection of Enterprise Street and Tulare Avenue, according to a report in the Visalia Times-Delta.

California Highway Patrol Officer Scott Harris said 21-year-old Mark Holguin Jr. of Tulare was driving a 2006 Mitsubishi Gallant northbound on Enterprise Street under the influence of both alcohol and drugs at the time of the accident.

Tulare Drunk Driving Accident LawyerHe ran the stop sign at Tulare Avenue and crashed into a 2012 Chevrolet Cruise driven by 26-year-old Jon Dillon, also of Tulare, Harris said. Holguin fled the scene.

Dillon suffered relatively minor injuries and was transported via ground ambulance to Kaweah Delta Medical Center to be treated. Two passengers suffered major injuries, according to the CHP report.

One of Holguin’s passengers — 22-year-old Rudy Tostarenteria  – suffered a broken pelvis, a back injury, and additional cuts and bruises.  Another passenger — 26-year-old Ashley Perry, suffered a large cut to her head, a collapsed lung, and additional cuts and bruises. She may have been a passenger in Dillon’s car, but the Times-Delta report was not clear on that.

Tostarenteria and Perry were transported to Community Regional Medical Center in Fresno, where Tostareteria was listed in serious condition. Information on Perry’s condition was not available.

Another passenger in Holguin’s vehicle — 20-year-olf Patrick Ragland — suffered scrapes and bruises. Police officers found Holguin and Ragland’s home after the accident. Holguin was arrested and taken into custody on charges of felony hit-and-run and driving under the influence of alcohol and drugs.

Ramona: Driver High on Aerosol Fumes, Plows Into Apartment

Ramona Car Accident Lawyers

A driver who apparently was high on aerosol fumes crashed his car into a Ramona apartment building on Friday and injured a woman who was standing inside.

•   A 21-year-old driver who apparently inhaled aerosol fumes from a can of Dust-Off lost control of his car and slammed into the side of an apartment building.

•   A woman who was inside the apartment was knocked down and seriously injured. She was airlifted to a hospital.

•   The driver sustained a minor head trauma. He was arrested on felony DUI charges.

The accident occurred at about 11:30 a.m., according to a report in the Ramona Sentinel.

California Highway Patrol officer Brian Pennings said 21 year-old Charles Scott of Imperial was driving under the influence of an inhalant when he slammed a 2005 silver Ford Focus into the Canyon Crest Apartments at Day and La Brea street.

Witnesses told the CHP that they saw Scott in the Kmart parking lot on Main Street just before the accident.

“He hit a median and a tree head-on,” Valli Clark said. She said Scott then backed up and hit another tree.

“He almost ran over a lady and her baby,” Clark said, noting that she saw him talking to another man and show him a can of Dust-Off. Lacy Willis, who was with Clark in the Kmart lot, said Scott was “very incoherent.”

The two women called 911 and then followed Scott because they were concerned that he was going to cause an accident.  Several other witnesses also told the CHP that Scott was speeding and driving erratically right before he crashed into the Canyon Crest apartments.

Jesus Montano, a landscaper who was four feet away from being hit by the car, told Channel 10 News the Focus was swerving wildly when it drove up to the two-story apartment building.

“You know, pretty much turning and trying to get control of the vehicle, but he never pressed on the breaks or anything,” Montano said. The car hit a street sign at the corner of La Brea and Day streets, careened into a parking lot, sideswiped a car in the lot, and then plowed into the apartment building, Pennings said.

Montano approached the car to see if he could help, but he said Scott looked dazed, as though he had no idea what was going on. The car smashed through the side of the building with such a forceful impact that it knocked down a woman who was standing in the kitchen on the other side of the wall.

The woman suffered moderate injuries and was airlifted to Palomar Medical Center in Escondido to be treated, according to a Ramona Patch news report. Scott, who was not wearing a seat belt, sustained a minor head injury and was taken to the same hospital via ground ambulance.

The accident damaged several apartments. Cal Fire emergency crew members told NBC News eight people were displaced by the accident. The American Red Cross responded to the scene to assist those victims with housing.

Scott was arrested on charges of felony driving under the influence, Penning said.

Redding: Dad Smoked Pot Before Crash That Injured Kids

Redding Drugged Driving Accident Lawyers

Warning: This story is heartbreaking.

A 28-year-old father who drove after he smoked medical marijuana and took other drugs faces felony DUI charges for a car accident that critically injured his two young daughtersOne of them suffered a paralyzing spinal cord injury.

•   A father smoked medicinal marijuana and then crashed his car with his two young daughters inside.

•   The girls were not properly secured in their child safety seats.

•   Both girls were critically injured. One is paralyzed from a spinal cord injury. The other had injuries to her face and may be blind in one eye.

•   The father is charged with felony DUI, several grave bodily injury enhancements, and chid endangerment.

The drugged driving accident occurred at about 8:45 p.m., according to a report in the Redding Record-Searchlight.

Nicolaas Alan Myrtle of Palo Cedro said the accident happened when he reached back to buckle one of his daughter’s seat belts that had become unbuckled, according to the California Highway Patrol report.

Redding Car Accident Lawyers

3-year-old Ashlynn Myrtle (left) and 4-year-old Alexis Myrtle were critically injured in a drugged driving accident.

Myrtle lost control of his car and ran off Gas Point Road near the Little League Fields in Cottonwood, about 15 miles south of Redding.  The car hit a concrete bridge abutment. His two daughters – 3-year-old Ashlynn and 4-year-old Alexis — suffered catastrophic injuries and remain hospitalized at Mercy Medical Center in Redding.

Ashlynn suffered a spinal cord injury and is paralyzed from the waist down, according to a report in the Mt. Shasta News. She is expected to be transferred later this week to Santa Clara Valley Medical Center in San Jose, where she’ll get specialized care for pediatric spinal injuries.

Alexis was on a life-support respirator until Sunday night, but is now breathing on her own. She underwent surgery to repair a deep gash in her face. It is not known whether she’ll have motor function or sight in her right eye.

CHP officer Michael Cregger said Myrtle told him that the two little girls were in their booster seats with their seat belts fastened when the crash happened. But he said the girls had a habit of taking the shoulder belts and tucking them underneath the arm rests of the booster seats.

When Cregger asked Myrtle if that is how the seat belts were positioned on the girls, he “looked down, started crying and shaking his head yes,” the CHP report stated.

Myrtle told officers he had smoked medical marijuana several hours before the accident. Officers found two prescription bottles for methadone and alprazolam (Xanax) in Myrtle’s car.

When officers interviewed Myrtle at the hospital following the accident, he said he had taken two methadone pills around 2 p.m. on the day of the crash and alprazolam about an hour after that. He told officers he takes the methadone for back pain and the other medication for anxiety.

Myrtle remains in Shasta County jail in lieu of $100,000 bail. He faces felony charges for driving under the influence with numerous enhancements for grave bodily injury, and child endangerment. Read the court documents for full details about the charges.

The girls’ mother, Amanda Pevehouse, told the Mt. Shasta newspaper that she’s taking it all one step at a time and is grateful for all the support she has received.

“Thank you to everyone who has been praying for my babies,” she said. “We’re thankful they’re alive.”

A community fund to help Pevehouse and her daughters has been set up at PremierWest Bank. The account number is 68016754. Donations can be made at any PremierWest Bank branch.

Drugged Driving Deaths on the Rise in California

California Car Accident Lawyers

Drugged driving is on the rise in California.

Drugged driving deaths are on the rise in California, according to an Office of Traffic Safety report issued this week.

•   Drugged driving fatalities are increasing and drunk driving fatalities are decreasing in California.

•   One in three drivers killed in accidents tested positive for drugs.

•   More people are now driving stoned than are driving drunk.

•   Part of the increase is due to the increase in legal marijuana usage.

The OTS report shows that one out of three drivers killed in car accidents in 2010 tested positive for legal and/or illegal drugs. That percentage that has been increasing since 2006, while drunk driving fatalities have decreased.

“You can be as deadly behind the wheel with marijuana or prescription drugs as you can with over-the-limit alcohol,” said OTS director Christopher J. Murphy. “The bottom line is drugs and driving do not mix.”

Research shows drugs have an adverse effect on judgment, reaction time, motor skills and memory – critical skills for safe and responsible driving, according to the OTS report.

A recent report released by Dalhousie University in Canada found that drivers who had used marijuana within three hours of driving had nearly double the risk of causing a crash as those not under the influence of alcohol or drugs. The Canadian research reviewed nine studies of more than 49,000 people involved in crashes.

Part of the increased in drug-impaired driving deaths is simply that more people now are driving stoned than are driving drunk.

Six cities in California conducted nighttime weekend “voluntary” roadside surveys and  found that the 8.4 percent of drivers who were pulled over tested positive for marijuana, while 7.6 percent were under the influence of alcohol.

Chris Cochran, a spokesman for the OTS, told the Los Angeles Times that increases in legal marijuana use and in prescription drug impairment could be contributing factors.

Despite these statistics, the general public remains unaware of the magnitude of the problem. Drug-impaired driving is often under-reported and under-recognized and toxicology testing is expensive. Additionally, because there is no established impairment level for drugs, prosecuting drug impaired driving cases can be difficult.

“We’re sort of where we were with drunk driving in 1950,” Cochran said, “we’re just getting a handle on it.”

Drug-impaired driving is “the new challenge” for both law enforcement and the judicial system, said Ventura County District Attorney Greg Totten.

“We need to make sure that drivers displaying objective signs of drug impairment either through bad driving or failed standardized field sobriety testing are arrested and prosecuted.”

The Office of Traffic Safety is working with the California Highway Patrol to train officers on how to spot drugged drivers and apprehend them. Police departments across the state also are being urged to train officers and become Drug Recognition Experts.

CHP Commissioner Joe Farrow said the training for law enforcement officers “is the key to successfully removing drug-impaired drivers from the road.”

Stolen Car Crashes on Train Tracks in Moreno Valley

Moreno Valley Car Accident Lawyers

Three occupants of a stolen car were seriously injured when the vehicle crashed on the railroad tracks in Moreno Valley. (Photo: Desert Sun)

A 20-year-old driver — who allegedly was high on methamphetamine — and two passengers narrowly escaped death when a stolen car crashed on railroad tracks Wednesday in Moreno Valley.

•   An unlicensed driver on methamphetamine lost control of a stolen car while driving at high speed on a curve.

•   The car rolled over onto some railroad tracks and ejected the driver and both of his passengers onto the tracks.

•   An oncoming freight train barely was able to stop in time to avoid running over the injured people. They were all hospitalized with major injuries.

•   The driver was arrested on several felony charges.

The accident occurred at 1:02 p.m., according to a report in the Desert Sun.

California Highway Patrol Officer Darren Meyer said Angel Morales of San Bernardino was driving a  Honda Civic that authorities believe was stolen earlier in Rialto.

Morales was driving the car westbound on San Timoteo Canyon Road at a high rate of speed when he attempted to pass another vehicle on a curve.

He crossed the double yellow lines as he tried to navigate the curve at high speed, but he lost control of the vehicle.

The car rolled over across the shoulder and onto the Union Pacific Railroad tracks that run parallel to the road. Morales and both of his passengers — who were not wearing seat belts — were thrown out of the car and onto the tracks. A freight train was coming down the tracks, but was able to stop just short of the scene.

“The conductor of an approaching freight train witnessed the collision and was able to stop the train just a few hundred feet from the (injured) bodies and damaged car on the tracks,” Meyer said.

The car also struck a power pole  and knocked it to the ground, but no power lines landed on the tracks.

Morales and both passengers suffered major injuries. They were taken to Riverside County Regional Medical Center, according to the Riverside Press-Enterprise. Meyer said they were in serious condition but were expected to survive.

Morales faces several charges, including felony driving under the influence of methamphetamine and causing great bodily injury, driving a stolen vehicle, and driving without a license.

San Timoteo Canyon Road was closed for several hours while emergency crews cleared the scene and a Southern California Edison crew worked to replace the downed power pole. Union Pacific train service was disrupted for two hours, Meyer said.
